These Terms & Conditions apply to the use of activity-circle.com and to free and Premium digital resources supplied through Activity Circle.

Activity Circle is operated by Chris Hawkins trading as Activity Circle.

By using this website, downloading a free resource or purchasing a Premium Resource Pack, you agree to these Terms & Conditions.

1. About Activity Circle

Activity Circle provides printable activity resources intended to support activity coordinators, carers, families, community groups and others providing activities and meaningful engagement.

2. Our resources

Activity Circle provides both:

  • Free Resources, which may be downloaded without payment; and

  • Premium Resource Packs, which are digital products available for purchase.

Individual product and resource pages describe what is included in each resource.

We aim to ensure that descriptions, previews, page counts and other information are accurate.

3. Digital products

Our Premium Resource Packs are supplied digitally, normally as PDF files.

No physical product will be sent unless a product page specifically states otherwise.

You are responsible for ensuring that you have suitable software and equipment to open and print the digital files you purchase.

4. Prices and payment

Prices are displayed on the website before you place an order.

The total amount payable will be shown during checkout before payment is completed.

Payment is processed through the payment methods available through our Wix ecommerce website.

Your order is accepted when we confirm your purchase and make the digital product available to you.

5. Access to digital downloads

Digital products will normally be made available shortly after successful payment.

You may receive access through:

  • a download link;

  • an order confirmation page;

  • an email; or

  • another download method shown during checkout.

If you experience a problem accessing a purchased resource, please contact us through the Contact Us page.

6. Cancellation rights for digital content

UK consumers normally have a 14-day cancellation period for distance contracts.

However, different rules apply where digital content is supplied immediately.

Before receiving immediate access to a digital download, you may be asked to:

  • expressly agree that supply of the digital content can begin immediately; and

  • acknowledge that you will lose your statutory right to cancel once supply begins.

Where you give this consent and acknowledgement, your right to cancel the purchase will end when supply of the digital content begins.

This does not affect your statutory rights where digital content is faulty, not as described or otherwise does not meet the requirements of consumer law.

7. Problems with a digital product

We want our resources to be supplied as described and to work as reasonably expected.

If a digital product is faulty, corrupted, materially different from its description or cannot be accessed because of a problem with the supplied file, please contact us.

Depending on the circumstances, we may:

  • provide a replacement download;

  • correct the resource;

  • provide another appropriate remedy; or

  • issue a refund where required.

Nothing in these Terms limits the rights available to consumers under applicable consumer law. UK consumer law requires digital content to be of satisfactory quality, fit for purpose where applicable and as described.

8. Licence to use Activity Circle resources

When you download or purchase an Activity Circle resource, you receive a licence to use it rather than ownership of the underlying intellectual property.

Unless a resource specifically states otherwise, you may:

  • download and store the resource;

  • print copies for your own use;

  • use the resource with people you support;

  • use it during activities within your care home, day centre, community group or similar setting; and

  • adapt how an activity is delivered to suit the people taking part.

For example, a care home purchasing a Resource Pack may print the materials as required for activities within that care home.

9. What you may not do

Unless we have given you written permission, you may not:

  • resell an Activity Circle resource;

  • redistribute the digital file to other organisations or individuals;

  • upload the resource to another website or file-sharing service;

  • publish substantial parts of a resource online;

  • remove Activity Circle branding and present the resource as your own;

  • reproduce the resources for commercial resale; or

  • use the resources to create a competing resource product.

Sharing a printed activity with the people taking part in the activity is, of course, permitted.

10. Free resources

Free Resources remain subject to these Terms & Conditions.

The fact that a resource is provided free of charge does not place it in the public domain or remove Activity Circle's intellectual property rights.

You may use Free Resources for the purposes described in these Terms, but you may not resell or redistribute the underlying digital files unless we specifically give permission.

11. Intellectual property

Unless otherwise stated, the design, original text, graphics, branding and other original content contained within Activity Circle resources and on activity-circle.com belong to Activity Circle or are used with appropriate permission.

Some resources may contain historical works or other material that is in the public domain or attributed to its original creator. Activity Circle does not claim ownership of third-party or public-domain works merely because they appear within one of our resources.

12. Appropriate use of resources

Activity Circle resources are designed to support activities, conversation and meaningful engagement.

They are not intended to:

  • provide medical advice;

  • diagnose or treat any health condition;

  • replace professional care or clinical judgement; or

  • guarantee a particular outcome for any individual.

The person delivering an activity remains responsible for deciding whether an activity is appropriate for the individuals taking part.

Activities should be adapted where necessary to reflect an individual's abilities, interests, circumstances and support needs.

13. Safety and supervision

Some activities may involve craft materials, scissors, movement, food, household items or other equipment.

You are responsible for assessing the suitability and safety of an activity for the people taking part and providing appropriate supervision where required.

14. External links and services

Activity Circle may link to external websites, music, videos or other third-party resources.

We are not responsible for the content, availability or privacy practices of third-party websites.

A link does not necessarily mean that Activity Circle endorses the third-party service.

15. Website availability

We aim to keep activity-circle.com and its downloads available, but we cannot guarantee uninterrupted access.

We may occasionally need to:

  • maintain the website;

  • update resources;

  • change website features;

  • remove outdated material; or

  • temporarily suspend access.

Where practical, we will try to minimise disruption.

16. Changes to resources

We may occasionally update Activity Circle resources to correct errors, improve content or reflect updated information.

The version available for future download may therefore differ slightly from an earlier version.

17. Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including any rights that cannot legally be excluded under consumer protection law.

Subject to those rights, Activity Circle is not responsible for losses resulting from:

  • use of a resource in a way for which it was not intended;

  • failure to appropriately supervise or adapt an activity;

  • reliance on Activity Circle resources as medical or professional advice;

  • third-party websites or services; or

  • circumstances outside our reasonable control.

19. Changes to these Terms

We may update these Terms & Conditions as Activity Circle develops or where legal or operational requirements change.

The latest version will be published on this page together with the date it was last updated.

Terms that applied when you made a purchase will continue to apply to that purchase where required by law.

20. Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer living elsewhere, you may also benefit from mandatory consumer rights provided by the laws of the country in which you live. Nothing in these Terms is intended to remove rights that cannot legally be excluded.
